The PROGRAM

The LICENSE

This is an EDUCATIONAL LICENSE for the use of the PROGRAM. By using an EDUCATIONAL LICENSE, the PROGRAM differs in the following ways from the commercial version:

· The customer data cannot be filled in, but will be replaced on each printout by the information of the LICENSOR.

· The installer information cannot be filled in, but will be replaced by the information of the LICENSEE on each printout.

· A watermark will be printed on each page.

The LICENSE is provided free of charge (€0) to the LICENSEE, each time for the duration of 1 academic year.

Method of distribution:

· The PROGRAM and updates for the PROGRAM are distributed via the website of the LICENSOR.

· Upon receipt of a signed application form, an activation file without a time limit will be sent via email to the LICENSEE.

User Agreement

Art. 1 – Provision, usage rights – A LICENSE allows the use of the PROGRAM for educational purposes. Commercial use is explicitly prohibited. The use is only permitted for instructors and learners affiliated with the educational institution of the LICENSEE. The usage rights for instructors and learners end when they are no longer affiliated with the institution.

Art. 2 – License Transfer – The PROGRAM is installed by default as a demo version with limited functionality. Only after receiving and installing an activation file will the PROGRAM function as a full version. Upon receipt of a signed application form, the LICENSOR will provide the LICENSEE with an activation file that is time-limited for the current academic year. This activation file can be used on an unlimited number of computers. Starting May 1, a new license file can be requested for the next academic year. The LICENSOR reserves the right to refuse this request.

Art. 3 – Restrictions – The license right is a strictly personal, exclusive, and non-transferable right. The PROGRAM remains the property of the LICENSOR. No copyrights are transferred. It is not permitted to sell, rent, lease, or lend copies of the PROGRAM. It is not allowed to subject the PROGRAM to reverse engineering, decompile, or disassemble.

Art. 4 – Copies of the PROGRAM – Copies of the PROGRAM or the documentation may only be made for preservation or for the purpose of using the PROGRAM as stated in Article 1. Making a copy for any other purpose is explicitly prohibited.

Art. 5 – Price and payment – The LICENSE is provided free of charge (€0).

Art. 6 – Product Warranty – In good faith, taking into account the complexity of the PROGRAM and the technologies used, the LICENSOR cannot guarantee that the PROGRAM is completely free of defects. No obligation for warranty can be imposed on the LICENSOR. Neither the LICENSOR nor any other party involved in the creation, production, or commercial distribution of the PROGRAM or updates to the PROGRAM can be held responsible for direct or indirect, material or immaterial damages, for losses of production, profit, data, programs, or for any other damages arising from the direct or indirect use or installation of the PROGRAM or the inability to use or install the PROGRAM.

Art. 7 – Support – Advice regarding the use and installation of the PROGRAM is made available through the accompanying documentation and the website of the LICENSOR. Additionally, the LICENSOR will strive to respond to questions and suggestions from the LICENSEE to the best of their ability within a reasonable timeframe.

Art. 8 – Updates – Updates of the PROGRAM will be regularly published on the website, which will include bug fixes and new functionalities. These updates can be downloaded, installed, and used free of charge by the LICENSEE under the same conditions as the initially obtained LICENSE. However, the LICENSOR reserves the right for the obtained LICENSE not to apply to any future completely new versions of the PROGRAM.

Art. 9 – Applicable Law – This agreement between the LICENSOR and the LICENSEE shall be governed by Belgian law. All disputes arising in connection with, resulting from, or related to this agreement shall be submitted to the court competent for the location where the principal office of the LICENSOR is established.
